Terms of Service

These Terms of Service (“Terms”) are a legal agreement between CollegeScoutHQ LLC (“CollegeScoutHQ,” “we,” “us,” or “our”) and the person accessing or using the Services (“you” or “user”).

These Terms govern access to and use of collegescouthq.com and CollegeScoutHQ’s college-search, recruiting, matching, roster, outreach, pipeline, subscription, custom-website, and related products and services collectively referred to as the “Services.”

By creating an account, clicking an acceptance box, purchasing a subscription, or using the Services, you agree to these Terms and acknowledge the Privacy Policy.

If you do not agree, do not use the Services.

This document is provided for transparency and does not constitute legal advice.

1. Eligibility

You must be at least 13 years old to use the Services.

If you are between 13 and 17 years old, you may use the Services only with the permission and supervision of your parent or legal guardian.

If you are a parent or guardian who approves a minor’s use of the Services, you:

  • Agree to these Terms on your own behalf and on behalf of the minor
  • Accept responsibility for the minor’s activity
  • Agree to supervise the minor’s use
  • Confirm that information submitted for the minor is accurate and lawfully provided
  • Authorize CollegeScoutHQ to process the minor’s information as described in the Privacy Policy

A minor may not purchase a paid subscription independently. A paid subscription for a minor must be purchased or expressly authorized by a parent or legal guardian who is legally capable of entering a contract.

The Services are not intended for children under 13.

2. Accounts

You must provide accurate, current, and complete account information.

You are responsible for:

  • Protecting your password and authentication credentials
  • Activity conducted through your account
  • Keeping contact and billing information current
  • Immediately notifying us of suspected unauthorized access

You may not:

  • Create an account using another person’s identity without authorization
  • Transfer or sell an account
  • Share login credentials outside your household unless we expressly permit it
  • Create multiple accounts to evade limits, fees, suspension, or enforcement

We may require verification of identity, age, parental authority, or account information.

3. Description of the Services

CollegeScoutHQ may provide features including:

  • College and athletic-program search
  • College-fit recommendations
  • Roster and graduation information
  • Estimated roster-opening insights
  • School lists
  • Recruiting-pipeline organization
  • Contact and interaction notes
  • Tracked outreach links
  • Email drafting and review
  • Tournament outreach tools
  • Subscription services
  • Coach-facing athlete profiles
  • Custom recruiting websites
  • Club- or team-sponsored access

Features may vary by sport, subscription, location, account type, or stage of product development.

We may add, modify, limit, suspend, or discontinue features. We do not guarantee that every feature will always be available.

4. Beta and Developing Features

Some Services may be designated beta, preview, experimental, or early access.

Beta features may:

  • Contain errors
  • Change without notice
  • Produce incomplete or inaccurate results
  • Be unavailable or discontinued
  • Result in temporary data loss

You use beta features at your own risk. CollegeScoutHQ does not guarantee that beta features will become generally available.

5. College, Roster, and Coach Information

CollegeScoutHQ may obtain information from public, licensed, user-provided, or third-party sources.

College, academic, roster, coaching, tournament, contact, eligibility, and recruiting information can change without notice. Information may be inaccurate, delayed, incomplete, duplicated, or attributed incorrectly.

You are responsible for independently verifying important information directly with the applicable college, coach, admissions office, athletic department, conference, association, or governing organization.

CollegeScoutHQ is not affiliated with, endorsed by, or acting on behalf of any college, athletic program, coach, admissions office, NCAA division, NAIA organization, conference, or athletic governing body unless expressly stated.

6. Artificial Intelligence and Recruiting Recommendations

CollegeScoutHQ may use automated analysis, artificial intelligence, statistical models, and historical data to generate:

  • College-fit rankings
  • School recommendations
  • Advantages and disadvantages
  • Roster-opening estimates
  • Outreach drafts
  • Recruiting suggestions
  • Other predictions or insights

These outputs are informational estimates only.

They are not professional educational, admissions, financial, eligibility, legal, or recruiting advice. They are not decisions or statements from a college or coach.

CollegeScoutHQ does not guarantee:

  • Admission to any institution
  • Recruitment by any coach or program
  • A roster position
  • Playing time
  • Athletic or academic eligibility
  • A scholarship or financial-aid award
  • Coach interest or response
  • The existence of a current or future roster opening
  • The accuracy of any AI-generated result
  • Any particular academic, athletic, financial, or employment outcome

You must independently evaluate recommendations before acting on them.

7. Tracked Links and Engagement Information

CollegeScoutHQ may allow users to generate tracked or uniquely assigned links.

When a recipient accesses a tracked link, the Services may record available engagement information such as:

  • Date and time
  • Number of accesses
  • IP address
  • Device and browser information
  • Approximate IP-derived location
  • The recipient or school label assigned by the user

Tracking information may be inaccurate or incomplete. Automated security scanners, bots, forwarded links, shared devices, privacy software, browser restrictions, and email-security systems may create or prevent recorded activity.

Tracking information does not conclusively prove that a particular person intentionally opened or reviewed content.

You may use tracked links only for lawful, legitimate recruiting-related communications.

You may not use tracked links:

  • For stalking, harassment, intimidation, surveillance, or retaliation
  • To track a person without a legitimate recruiting-related purpose
  • To misrepresent the nature of the link
  • To collect sensitive information
  • To circumvent privacy or security controls
  • In violation of law, contract, school policy, tournament policy, or a recipient’s request
  • For employment, housing, credit, insurance, medical, or other regulated eligibility decisions

We may disable tracking features or accounts that create legal, safety, privacy, deliverability, or abuse risks.

8. Email and Outreach Rules

You are responsible for communications sent through or using the Services.

You represent that:

  • Your sender information will be accurate
  • Your subject lines and message content will not be deceptive
  • You have a lawful basis to contact recipients
  • You will honor requests not to receive further messages
  • You will comply with applicable anti-spam, privacy, recruiting, school, and athletic rules
  • You will not use purchased, stolen, scraped, or unlawfully obtained mailing lists
  • Your messages will not impersonate CollegeScoutHQ, a school, coach, or governing body

You may not use the Services to send:

  • Spam
  • Fraudulent or misleading messages
  • Threats or harassment
  • Malware or harmful code
  • Unlawful advertisements
  • Messages that violate a suppression or opt-out request
  • Mass communications unrelated to legitimate athletic recruiting

We may impose sending limits, maintain suppression lists, investigate complaints, and suspend sending privileges.

CollegeScoutHQ does not guarantee delivery, inbox placement, opening, response, or coach engagement.

9. Free and Paid Plans

CollegeScoutHQ may offer free, monthly, annual, multi-year, custom-priced, trial, promotional, club-sponsored, or other plans.

Features, limits, and pricing are described at checkout or in an applicable order form.

We may change plan features or prices prospectively. A price change will not apply to a paid billing period that has already begun.

10. Automatic Renewal

Unless checkout expressly states otherwise, a paid subscription automatically renews for successive periods matching the selected billing term.

By purchasing an automatically renewing subscription, you authorize CollegeScoutHQ or its payment processor to charge the payment method on file:

  • At the time of purchase
  • At the beginning of each renewal period
  • For applicable taxes and disclosed fees

The checkout page will state the price, billing frequency, renewal terms, and cancellation method before purchase.

Annual and multi-year renewal reminders may be sent to the account email before renewal.

You are responsible for keeping your email and payment information current.

11. Cancellation

You may cancel an automatically renewing subscription through the cancellation method made available in your account or by contacting support@collegescouthq.com.

Cancellation stops future renewal charges. Unless otherwise stated, cancellation takes effect at the end of the current paid billing period, and access to paid features continues until that period ends.

Deleting an application, abandoning an account, failing to use the Services, removing a payment method, or asking a bank to block a charge does not by itself cancel a subscription.

We will provide confirmation when a cancellation request has been completed.

12. Refund Policy

Monthly Subscriptions

Monthly subscription charges are nonrefundable after the billing period begins, except where required by law or where CollegeScoutHQ confirms a duplicate or erroneous charge.

Initial Annual or Multi-Year Purchases

A purchaser may request a refund of an initial annual or multi-year subscription payment within seven calendar days after purchase.

We may deny or reduce a refund where the account has materially used paid features, including substantial AI analysis, bulk outreach, Tournament Blast, custom work, or other usage that creates significant cost.

Annual or Multi-Year Renewals

A purchaser may request reversal of an accidental annual or multi-year renewal within seven calendar days after the renewal charge, provided that the account has not materially used paid features after renewal.

Trials and Promotions

Trial and promotional terms shown at enrollment control. When a trial converts to a paid plan, the disclosed payment method may be charged unless the subscription is canceled before conversion.

Custom and Elite Services

Custom websites, domain registration, design, hosting, club services, and other custom work may be governed by a separate order form.

Deposits and amounts covering work already performed, third-party purchases, domain registrations, or nonrecoverable costs may be nonrefundable as stated in the order form.

Legally Required Refunds

Nothing in this section limits any refund, cancellation, or consumer right that cannot lawfully be waived.

Refund requests must be submitted to support@collegescouthq.com and include the account email and transaction information reasonably necessary to locate the purchase.

13. Payment Processing

Payments may be processed by a third-party payment processor.

You authorize the payment processor to store and charge your selected payment method according to the subscription or order terms.

CollegeScoutHQ is not responsible for a payment processor’s independent acts, outages, or security practices, but this does not limit rights that cannot legally be waived.

You are responsible for applicable taxes unless we are legally required to collect them.

14. User Content

“User Content” means information or material submitted, uploaded, entered, created, or transmitted by a user, including:

  • Athlete profile information
  • Photographs
  • Videos and links
  • Statistics
  • Recruiting materials
  • School and coach notes
  • Communications
  • Website content
  • Feedback

You retain ownership of your User Content.

You grant CollegeScoutHQ a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, modify for technical purposes, display, and transmit User Content only as reasonably necessary to:

  • Provide the Services
  • Generate requested analysis
  • Send user-directed communications
  • Publish a requested profile or website
  • Protect and improve the Services
  • Enforce these Terms
  • Comply with law

This license ends when the content is deleted, except where continued retention is reasonably required for backups, legal compliance, security, dispute resolution, or content already shared at the user’s direction.

You represent that:

  • You own or have permission to use User Content
  • Submission and use of the content will not infringe another person’s rights
  • The information is not materially false or misleading
  • You have obtained required permission before submitting information about another person
  • A parent or guardian has approved public content concerning a minor

15. Public Profiles and Recruiting Websites

Public profiles and custom recruiting websites may be visible to coaches, schools, search engines, and the general public.

You are responsible for selecting and approving public information.

For a user under 18, a parent or legal guardian must approve publication.

You may not publish:

  • Home addresses
  • Full birth dates
  • Government identifiers
  • Account credentials
  • Private medical information
  • Content that creates an unreasonable safety risk
  • Content that infringes another person’s privacy or intellectual-property rights

Removal from CollegeScoutHQ may not immediately remove copies stored by search engines, archives, recipients, or third parties.

16. Clubs and Teams

A club, team, trainer, or other organization may sponsor or facilitate access only under terms approved by CollegeScoutHQ.

An organization may not:

  • Create or manage a minor’s account without required parent authorization
  • Sell athlete data
  • Use athlete information for unrelated marketing
  • Access information beyond its authorized role
  • Retaliate against an athlete for disconnecting an account
  • Misrepresent its relationship with CollegeScoutHQ

Additional club, data-processing, affiliate, or order terms may apply.

If separate terms conflict with these Terms, the separate terms control for the covered club service.

17. Prohibited Conduct

You may not:

  • Violate any law or regulation
  • Infringe intellectual-property, privacy, publicity, or other rights
  • Impersonate another person or organization
  • Submit false recruiting, academic, athletic, or identity information
  • Harass, threaten, stalk, or exploit another person
  • Scrape, harvest, or collect information through unauthorized automated means
  • Reverse engineer or attempt to extract source code except where legally permitted
  • Bypass rate limits, access controls, subscriptions, or security protections
  • Introduce malware or harmful code
  • Disrupt or overload the Services
  • Resell access without written permission
  • Use the Services to build a competing database, model, or product
  • Use AI outputs as the sole basis for a high-impact or regulated decision
  • Use college or coach contact data for unrelated advertising or solicitation
  • Encourage another person to violate these Terms

18. CollegeScoutHQ Intellectual Property

The Services, including software, interfaces, designs, branding, compilations, databases, text, graphics, and original content, are owned by CollegeScoutHQ or its licensors and protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the Services for legitimate college-search and athletic-recruiting purposes.

No ownership rights are transferred to you.

“CollegeScoutHQ,” associated logos, and related branding may not be used without written permission.

19. Third-Party Services

The Services may contain links or integrations involving colleges, athletic departments, payment processors, video platforms, social networks, email services, analytics providers, or other third parties.

CollegeScoutHQ does not control third-party services and is not responsible for their content, accuracy, availability, terms, privacy practices, or conduct.

Your use of third-party services may be governed by separate terms.

20. Suspension and Termination

You may stop using the Services at any time.

We may limit, suspend, or terminate access where reasonably necessary because of:

  • A violation of these Terms
  • Fraud or unlawful conduct
  • Harassment, spam, or abuse
  • Security or privacy risk
  • Payment failure
  • Legal or regulatory requirements
  • Risk to another user, recipient, CollegeScoutHQ, or the Services
  • Discontinuation of the Services

Where reasonable, we may provide notice and an opportunity to correct a violation. Immediate action may be taken where necessary to address safety, security, legal, payment, or abuse concerns.

Termination does not automatically entitle a user to a refund.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

COLLEGESCOUTHQ DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
  • INFORMATION WILL BE COMPLETE OR CURRENT
  • AI RESULTS WILL BE ACCURATE
  • TRACKING RESULTS WILL IDENTIFY A PARTICULAR PERSON
  • A COACH WILL VIEW OR RESPOND TO A MESSAGE
  • A USER WILL BE RECRUITED OR ADMITTED
  • A ROSTER OPENING WILL EXIST
  • DATA LOSS OR SECURITY INCIDENTS WILL NEVER OCCUR

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS. IN THOSE JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLEGESCOUTHQ AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST OPPORTUNITIES, LOST PROFITS, REPUTATIONAL HARM, OR RECRUITING OUTCOMES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLEGESCOUTHQ’S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID COLLEGESCOUTHQ DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED UNITED STATES DOLLARS.

These limitations do not apply where liability cannot lawfully be excluded or limited.

23. Indemnification

To the maximum extent permitted by law, adult users and parents or guardians responsible for a minor’s account agree to defend, indemnify, and hold harmless CollegeScoutHQ and its owners, employees, contractors, and affiliates from third-party claims arising from:

  • User Content
  • Unlawful outreach
  • Misuse of tracking features
  • Infringement of another person’s rights
  • A material violation of these Terms
  • Fraudulent or unlawful conduct

This provision does not require indemnification for CollegeScoutHQ’s own unlawful conduct where prohibited by law.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Before filing a lawsuit, you and CollegeScoutHQ agree to attempt in good faith to resolve the dispute by sending a written description of the issue and requested resolution.

Unless applicable consumer law requires otherwise, disputes that cannot be resolved informally will be brought in the state or federal courts located in New Jersey, and the parties consent to those courts’ jurisdiction.

Nothing in these Terms waives a consumer protection or other legal right that cannot lawfully be waived. Eligible claims may be brought in small-claims court.

25. Changes to These Terms

We may update these Terms to reflect changes in the Services, business practices, or law.

We will post updated Terms with a revised effective date. Where required, we will provide additional notice or request renewed acceptance before a material change applies.

Changes will apply prospectively. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.

26. General Terms

If a provision is held unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver.

You may not assign your account or rights under these Terms without our permission. We may assign these Terms in connection with a merger, reorganization, financing, sale, or transfer of the Services.

These Terms, the Privacy Policy, applicable order forms, and expressly incorporated policies constitute the agreement governing the Services.
